It works out overtime and night-work pay for an employee in Vietnam on a monthly time-based salary, following the Labour Code 2019 (Bộ luật Lao động 2019, Article 98) and Decree 145/2020/NĐ-CP (Articles 55 to 57). Enter the monthly salary that counts for overtime, the normal working days and hours your company uses, and the overtime hours of each kind; the tool shows the hourly wage, the pay for each kind of hour with its rate, the total, and whether the hours go over the legal caps. Rules as of 14 October 2026. It is a guide to the legal minimums, not a payslip: a contract or collective agreement may pay more. Everything is calculated on this page.
The rates
Overtime pay = hourly wage × rate × hours. The minimum rates are:
| Hour | Rate | Formula |
|---|
| Overtime on a normal working day | 150% | 150% |
|---|
| Overtime on the weekly rest day | 200% | 200% |
|---|
| Overtime on a public holiday, Tết or paid leave day | 300% | 300% |
|---|
| Night overtime, normal day, no daytime overtime before | 200% | 150% + 30% + 20% × 100% |
|---|
| Night overtime, normal day, after daytime overtime | 210% | 150% + 30% + 20% × 150% |
|---|
| Night overtime on the weekly rest day | 270% | 200% + 30% + 20% × 200% |
|---|
| Night overtime on a holiday | 390% | 300% + 30% + 20% × 300% |
|---|
| Night work inside normal hours | +30% | on top of the normal pay |
|---|
Night means 22:00 to 06:00 (Article 106). Night overtime adds the 30% night premium and a further 20% of the daytime hourly wage of that day, which is why the night rate depends on the day and on whether you already worked overtime during the day. For a monthly-paid employee the holiday's own pay is already in the salary; the 300% is paid on top of it.
The hourly wage: 26 days or your actual schedule?
Decree 145 defines the hourly wage as the actual pay for the job in the month divided by the actual normal hours worked, with the number of days no more than the normal working days in the employer's rules. It does not fix the divisor at 26. Many payrolls use 26 days (a six-day week); companies on a five-day week often use 22, and five and a half days about 24. The choice changes the result: a salary of 11,000,000 ₫ over 22 days of 8 hours is 62,500 ₫ an hour, over 26 days only 52,884.62 ₫, so ten hours of weekday overtime pay 937,500 ₫ or 793,269 ₫. Use the figure in your company's internal rules or labour contract.
The salary that counts includes the job pay and job-related allowances; it excludes overtime and night pay themselves, holiday pay, bonuses, and allowances such as meals, fuel, phone, transport, housing and childcare.
Worked examples
With a salary of 10,400,000 ₫, 26 days and 8 hours, the hourly wage is 10,400,000 ÷ 208 = 50,000 ₫.
- 10 hours of weekday overtime: 50,000 × 150% × 10 = 750,000 ₫.
- On Sunday (the weekly rest day), 4 hours in the day and 2 at night: 4 × 100,000 + 2 × 135,000 = 670,000 ₫.
- On a public holiday, 8 hours in the day and 3 at night: 8 × 150,000 + 3 × 195,000 = 1,785,000 ₫, on top of the normal pay for the holiday.
- On a weekday, 2 hours of overtime until 22:00, then 2 more hours: 2 × 75,000 + 2 × 105,000 = 360,000 ₫. The same 2 night hours without the daytime overtime earn 200,000 ₫.
The legal limits
Overtime needs the employee's consent and may not exceed 50% of the normal daily hours (12 hours a day in total on a weekly schedule), 40 hours a month and 200 hours a year, or 300 hours a year in the sectors and cases listed in Article 107(3), such as export textiles, garments, leather and footwear, electronics, power, telecommunications and urgent seasonal work. The tool warns when the month's hours or the year's total (add the hours already worked this year) go over. Daily limits depend on each day's schedule and are not checked.
